What is Personal Injury Law?

Personal injury is an area of the law under which negligent or careless individuals, companies, agencies, and other entities can be held responsible for their failure to use reasonable care in their dealings with others. All personal injury claims, whether based on intentional wrongdoing or negligence, require the resolution of two issues: liability and damages. The former involves proving who was responsible for the injury in question, which in turn, may require demonstrating that that individual or entity was negligent. Once this has been established, a jury will be tasked with determining the nature and extent of the damages, or the harm, that the plaintiff suffered. If both liability and damages can be established, then the injured party can be awarded compensation for his or her losses.

Obtaining Compensation

There are two ways to obtain compensation after an accident: through settlement negotiations or through the court system. The first doesn’t take place in a courtroom, but involves negotiating with the at-fault party, or its insurers, in an effort to reach a settlement, wherein the injured party obtains compensation in exchange for not taking the case to trial. Most are encouraged to at least attempt settlement proceedings before going to trial, as the latter can be time-consuming and expensive. If, however, an agreement is not possible, then the claimant can take the case to court, where a jury will be tasked with determining whether the defendant was responsible for the accident and if so, how much of a monetary award will make the plaintiff whole. Jury awards are often higher than settlement amounts, but going to court can be risky.

Ultimately, which route is in an injured party’s best interests will depend on the specific facts of the case, including the type of accident in which the parties were involved, the parties’ degree of fault, and the severity of the injuries sustained.
